1. Acceptance of Terms

By accessing this website and participating in any auction or transaction with Maine-West Equipment (“Company”), you agree to be bound by the following Terms & Conditions. If you do not agree, please do not use this website or participate in any auctions.

2. Auction Participation & Buyer Responsibilities

The highest bidder (“Buyer”) is responsible for:
Contacting Maine-West Equipment via phone or email within 24 hours of auction completion to confirm payment method

• Completing full payment within 48 hours of auction completion, unless prior arrangements have been approved

Failure to comply may result in forfeiture of the item and/or additional action at the Company’s discretion.

3. Payment Terms

No equipment will be released until payment is received in full

• A 4% convenience fee will be applied to all credit card transactions

• International purchases must be paid via wire transfer

• Bank fees will be applied:

• $20 (U.S. wire transfers)

• $35 (International wire transfers)

4. Sales Tax

Applicable North Dakota sales tax will be collected in accordance with state tax laws

5. Titles & Ownership Transfer

Titles will be mailed to the Buyer once made available by the seller
If a lien exists on the item:

• Title will be mailed no earlier than 30 days after payment is received

6. Equipment Condition & Sales Finality
All equipment is sold “AS-IS, WHERE-IS”, with no guarantees or warranties expressed or implied

• Equipment descriptions are believed to be accurate but are not guaranteed

• All sales are final

Buyers are strongly encouraged to inspect items and ask questions prior to the auction closing.

7. Post-Purchase Responsibilities
Upon taking ownership of equipment, the Buyer agrees to:

• Remove all identifying labels, phone numbers, and stickers from prior owners

• Ensure equipment is properly rebranded before being put into service

8. Pickup & Storage Policy

• Standard pickup hours:

Monday – Friday, 8:00 AM – 5:00 PM
Unless otherwise agreed upon in advance
Equipment must be picked up within 30 days of purchase
After 30 days:
A minimum $25/day storage fee will be applied
Fees may increase depending on equipment size
After 60 days:
Equipment will be considered abandoned
Items may be resold without refund

9. Limitation of Liability

Maine-West Equipment shall not be held liable for:

• Errors or omissions in equipment listings

• Delays in title processing due to liens or third parties

• Losses resulting from participation in auctions or use of purchased equipment

10. Modifications to Terms

Maine-West Equipment reserves the right to update or modify these Terms & Conditions at any time. Continued use of the website or participation in auctions constitutes acceptance of any updates.
